TERMS OF USE | PavApps

These Terms of Use ("Terms") apply to all apps published by PavApps, including Attended, Contested, Subbed, Coached, and any future apps released under the PavApps name (each, an "App"). By downloading, installing or using an App, you agree to these Terms. If you do not agree, please do not use the App. These Terms supplement Apple's Standard Licensed Application End User License Agreement.

Licence

Subject to your compliance with these Terms, PavApps grants you a limited, non-exclusive, non-transferable, non-sublicensable licence to download and use the App on any Apple-branded device you own or control, as permitted by the App Store Usage Rules. You may use the Apps for your own coaching, teaching and organising activities, including as a coach, teacher or staff member of a club, school or organisation.

Accounts (Coached)

Some Coached features require an account, including publishing to the community library, buying a Club plan, and joining or managing a club. Coached accounts are intended for coaches and club staff, not children. When you create an account you agree to:

- Provide an email address you have access to

- Keep your password secure

- Take responsibility for activity on your account

You can delete your account at any time in the app (Settings → Account → Delete Account) or by emailing support@pavapps.com.au from the email address on the account. Deleting your account does not cancel an App Store subscription.

Subscriptions & In-App Purchases

Some Apps, including Contested and Coached, offer auto-renewable subscriptions and/or one-time purchases ("Purchases") to unlock additional features. Where an App offers a Purchase:

- Payment is charged to your Apple Account at confirmation of purchase.

- Auto-renewable subscriptions automatically renew for the same length and price unless auto-renew is turned off at least 24 hours before the end of the current period.

- Your account is charged for renewal within 24 hours before the end of the current period.

- Free trials, where offered, convert to a paid subscription at the end of the trial unless cancelled at least 24 hours before the trial ends.

- You can manage or cancel subscriptions in your Apple Account settings. PavApps cannot cancel a subscription on your behalf.

- Refunds are handled by Apple under Apple's policies. PavApps does not process payments or refunds and never has access to your payment information.

- One-time purchases are a single, non-recurring charge that unlocks the relevant features for your Apple Account, subject to these Terms.

Club Plans (Coached)

A Club plan is purchased by a club administrator and provides access for the administrator and the coaches they invite, up to the number of users included in the plan. The administrator is responsible for who is invited to and removed from the club. Members' premium access depends on the club's subscription remaining active. If the subscription ends, members lose premium access, but drills and sessions stored on their own devices remain. For clubs needing more users, contact us for a quote.

Clubs and shared content (Coached)

Automatic sharing. While you are a member of a club, drills and sessions you create or edit in Coached are shared with that club automatically. By joining a club you agree to this.

Permission you give. You give the club and its members permission to view, use and copy the items you share, for as long as the items remain in the club. This permission continues if you leave the club or delete your account.

Editing and removal. Only you and the club's admins can edit an item you have shared. Only admins can remove items from the club. Removal deletes the item for all members.

Ownership. PavApps does not claim ownership of the drills and sessions you create. Who owns work shared with a club is a matter between you and the club, and PavApps is not a party to that arrangement or to any dispute about it.

Admins. Club admins are responsible for managing their club's members and content, and for making sure coaches understand that their work is shared.

End of membership. If you are removed from a club or the club's subscription ends, you lose access to the club's shared content. The app will tell you and offer individual plans.

Community Library (Coached)

Coached lets you publish drills and sessions to a community library that other Coached users can view and copy.

When you publish content, you confirm that you created it or have the right to share it, and you grant PavApps a worldwide, non-exclusive, royalty-free, perpetual licence to store, display, translate and distribute it within Coached. Other users may view, copy and use published content for their own coaching.

Published content is permanent. It stays in the library if you delete your account, shown as by "Former coach", with nothing linking it to you. If you need personal information removed from something you have published, contact us.

There is no tolerance for objectionable content or abusive users. You must not publish content that:

- Is unlawful, offensive, hateful, discriminatory, sexually explicit, violent or harassing

- Infringes anyone else's copyright, trademarks or other rights

- Contains personal information about other people, especially children

- Is spam, advertising or unrelated to coaching

You can report content and block other coaches from within the app. We are notified of every report and aim to review reports within 24 hours. We may remove any content that breaks these Terms and suspend or remove the accounts of users who post it, without notice.

Your Own Content

Where an App lets you enter your own content (such as team names, tournament data, attendance records, drills or sessions), you keep all rights to it and are responsible for it. Content you do not publish stays on your device or in your own iCloud account.

Coaching Safety

Drills, sessions and other content in the Apps, including community content, are provided for general guidance. You are responsible for deciding whether an activity is suitable and safe for your players, and for supervising them appropriately.

Third-Party Services

Some Apps use Apple's iCloud and CloudKit to sync or share data at your direction, subject to Apple's terms and privacy policy. Coached also uses Supabase (accounts, library and clubs), RevenueCat (subscriptions), DeepL (library translation) and Google Gmail (support and account emails). Disclaimer of Warranties

Apps are provided "as is" and "as available", without warranties of any kind, to the fullest extent permitted by law. PavApps does not warrant that an App will be uninterrupted, error-free or free of harmful components.

Limitation of Liability

To the fullest extent permitted by law, PavApps is not liable for any indirect, incidental, special, consequential or punitive damages arising out of or related to your use of, or inability to use, an App. Nothing in these Terms excludes, restricts or modifies any rights you have under the Australian Consumer Law or other laws that cannot be excluded.

Termination

You may stop using an App at any time by deleting it from your device, and you may delete your Coached account at any time. PavApps may suspend or terminate your access to an App's online features if you break these Terms.

Changes to These Terms

We may update these Terms as new Apps are released or features change. The date at the top of this page shows the latest revision. Continued use of an App after changes means you accept the updated Terms.

Governing Law

These Terms are governed by the laws of Western Australia, Australia.
